In April 2021, the new IR35 rules come into force for the private sector \u2013 rules that are already in place for the public sector. Are you ready for these changes?<\/span><\/p>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">If your company works with contract staff, the new IR35 reform could well be a problem. You\u2019ll need to establish whether the rules apply \u2013 both to existing and to future contractors \u2013 so that neither you nor your contractors are accused of tax avoidance. As the hiring company, you will be responsible for determining whether a contractor falls within IR35 rules.<\/span><\/p>\n<blockquote>\n<p dir=\"ltr\">\n\t\t<em><strong><span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Are you ready for IR35?<\/span><a href=\"https:\/\/www.identifiglobal.com\/contact-us\/\" target=\"_blank\" rel=\"noopener\"> Let us know if there\u2019s anything we can do to help<\/a>.<\/strong><\/em><\/p>\n<\/blockquote>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Here, we lay out what \u2018inside IR35\u2019 and \u2018outside IR35\u2019 actually mean, how to check a contractor\u2019s IR35 status, and what you\u2019ll need to do before April.<\/span><\/p>\n<h2 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">What does it mean to be \u2018inside IR35\u2019 or \u2018outside IR35\u2019?<\/span><\/h2>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Put simply, IR35 legislation applies if an individual you have hired as a contractor would actually be an employee \u2018if there was no intermediary\u2019. By \u2018intermediary\u2019, HMRC are referring to someone who is avoiding paying an employee\u2019s income tax and National Insurance Contributions that they would be paying if hired directly. These tax benefits come through working through a personal service company (PSC) \u2013 working through a limited company instead of being added to PAYE.<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Inside IR35 &#8211; \u2018deemed employment\u2019<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Under the new intermediaries legislation, contractors who fall inside IR35 will be \u2018deemed employees\u2019 of the end client. As such, any tax efficiency from contracting will be lost, as they will be regarded as subject to PAYE.<\/span><\/p>\n<h4 dir=\"ltr\" style=\"text-align: center\">\n\t<span>&#8220;A<\/span>&nbsp;\u2018deemed payment\u2019 will need to be made to HMRC.&#8221;<\/h4>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">In cases where a contractor is inside IR35, a \u2018deemed payment\u2019 will need to be made to HMRC at the end of the tax year. Alternatively, the contractor will need to organise a contract review prior to the new rules coming in, to avoid IR35 applying.<\/span><\/p>\n<p dir=\"ltr\" style=\"text-align: center\">\n\t<img decoding=\"async\" alt=\"\" src=\"https:\/\/cdn-01.cms-eu-v2i.applyflow.com\/identifi-global\/wp-content\/uploads\/2022\/12\/DeemedEmployment.jpg\" style=\"width: 600px; height: 400px\"><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Outside IR35<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">To be considered as operating outside of IR35 rules means that a contractor works as a genuine contracted business to a client in the private sector, rather than acting as an employee. However, even if a contractor has determined that they are outside of IR35, they can still be subject to checks from HMRC.<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">How to check if your contractors are inside IR35<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">While many recommend using the government\u2019s<\/span><a href=\"https:\/\/www.gov.uk\/guidance\/check-employment-status-for-tax\" target=\"_blank\" rel=\"noopener\"> CEST (Check Employment Status for Tax) tool<\/a>, we would advise against it. This tool has proved to be incredibly basic \u2013 and, in some legal cases in the public sector, has been found by HMRC to have wrongly determined a contractor\u2019s IR35 status.<\/p>\n<blockquote>\n<p dir=\"ltr\">\n\t\t<em><strong><span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">For a detailed review of IR35 for employers, <a href=\"https:\/\/identifiglobal.hubspotpagebuilder.com\/ir35-guide\" target=\"_blank\" rel=\"noopener\">download our new guide<\/a>.<\/span><\/strong><\/em><\/p>\n<\/blockquote>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Instead, a business should establish the following:<\/span><\/p>\n<ul>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">How much <\/span>control the contractor has over the work they do, their hours and their workplace.<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Whether the contractor is able to send a <\/span>substitute to do the work, whether this has ever been done, and whether the hiring company can reject this substitute.<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Whether there is a <\/span>binding commitment or contract for the hiring company to offer work, or the contractor to supply work.<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">How <\/span>integrated the contractor is into the business: whether they would describe themselves as working for the company, or working for themselves.<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Whether the contractor has taken on any <\/span>major financial risk \u2013 like buying their own equipment.<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">\n\t\t\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Various other factors, like how much of the contractor\u2019s time the work takes up, and whether there are any restrictions on other work they can do. <\/span><\/p>\n<\/li>\n<\/ul>\n<h2 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">What to do before April<\/span><\/h2>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">There are four key things that all businesses who hire \u2013 or are planning to hire \u2013 contractors should do before April 2021 comes around.<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">1. A review of all members of staff \u2013 both contract and permanent<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Conducting a review of all permanent and contract staff, to establish which members of your team fall inside and outside IR35. While the government has provided an online tool to do so, this is inefficient: instead, establish in-house expertise or hire a professional recruitment law firm to undertake this task for you.<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">2. Understand likely costs (both financial and administrative)<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">This will be particularly pertinent to small businesses, who may find that keeping on contractors with IR35 rules in place will be too costly. Do you need to replace contract staff with permanent staff, or hire an alternative contractor who is willing to work within IR35?<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">3. Communicate the changes to all involved<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">All changes should be communicated with both current and potential future contractors in a clear and transparent way. Not only does this give them time to prepare and to give their feedback \u2013 it also aids their understanding, cements trust and strengthens your relationship with them.<\/span><\/p>\n<h3 dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">4. Review recruitment processes<\/span><\/h3>\n<p dir=\"ltr\">\n\t<span id=\"docs-internal-guid-acc87b11-7fff-263c-07af-b133c4082233\">Are your job adverts designed with IR35 in mind? Do they make it clear whether a contract role is inside or outside of IR35?
